Terms of Service

These Terms of Service ("Terms") govern your use of LTV Analyzer ("Service"), operated by DataXia Tech ("we", "us", "our"). By using the Service, you agree to these Terms.

1. Service Description

LTV Analyzer is a web-based tool that analyzes customer transaction data to generate Customer Lifetime Value (CLV) predictions and customer segments. The Service uses statistical models (BG/NBD and Gamma-Gamma) to produce estimates based on historical data.

Important: All predictions are statistical estimates and should not be relied upon as the sole basis for business decisions. Past transaction patterns do not guarantee future customer behavior.

2. Account & Eligibility

• You must be at least 18 years old to use the Service.
• You are responsible for maintaining the security of your account credentials.
• You may not create multiple free accounts to circumvent usage limits.

3. Free & Paid Plans

3.1 Free Analysis

We offer a free tier that allows you to:

• Upload a CSV file with up to 50,000 rows
• Run one LTV analysis
• View a preview of results (top 50 customers)

3.2 Paid Subscriptions

Paid plans (Starter, Pro) provide additional features including full result downloads, larger file limits, and advanced segmentation. Pricing is displayed on our website and may change with 30 days' notice.

3.3 Payment Processing

All payments are processed by Paddle.com as the Merchant of Record. Paddle handles VAT/tax collection, invoicing, and payment processing. By purchasing a subscription, you also agree to Paddle's Terms of Service.

4. Your Data

4.1 Ownership

You retain full ownership of all data you upload to the Service. We do not claim any intellectual property rights over your data.

4.2 License to Process

By uploading data, you grant us a limited, temporary license to process your data solely for the purpose of generating your LTV analysis. This license terminates when your data is deleted.

4.3 Data Handling

• Uploaded CSV files are automatically deleted within 24 hours.
• Analysis results are available for download for 7 days, then automatically deleted.
• We do not use your data to train models, improve algorithms, or for any purpose other than generating your specific analysis.
• We do not share your data with third parties (except infrastructure providers as described in our Privacy Policy).

4.4 Your Responsibilities

• You must have the right to upload and process the data you provide.
• You must not upload data that contains sensitive personal information (health, financial account numbers, social security numbers, etc.) unless absolutely necessary for the analysis.
• You are responsible for compliance with applicable data protection laws (GDPR, CCPA, etc.) regarding the data you upload.

5. Acceptable Use

You agree NOT to:

• Upload malicious files, scripts, or code disguised as CSV data
• Attempt to overload, disrupt, or gain unauthorized access to the Service
• Use the Service to process data obtained illegally
• Resell access to the Service without our written permission
• Use automated tools to scrape or bulk-access the Service
• Circumvent usage limits or access controls

6. Refund Policy

• You may request a full refund within 7 days of purchase.
• Refunds are processed through Paddle and typically take 5-10 business days.
• After 7 days, refunds are granted at our discretion on a case-by-case basis.

7. Service Availability

• We aim for high availability but do not guarantee 100% uptime.
• We may perform maintenance with reasonable notice.
• We are not liable for any losses caused by Service downtime.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" without warranties of any kind.
• LTV predictions are statistical estimates and are not guaranteed to be accurate.
• We are not liable for any direct, indirect, or consequential damages arising from your use of the Service or reliance on its outputs.
• Our total liability is limited to the amount you paid for the Service in the 12 months prior to the claim.

9. Intellectual Property

• The Service, including its design, code, and documentation, is owned by DataXia Tech.
• You may not copy, modify, or reverse-engineer any part of the Service.
• Your data and analysis outputs belong to you.

10. Termination

• You may cancel your subscription at any time through Paddle's customer portal.
• We may suspend or terminate your account if you violate these Terms.
• Upon termination, your data will be deleted according to our retention policy.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the website at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of Spain. Any disputes shall be resolved in the courts of Barcelona, Spain.
